Terms of Service

1. The Service

Drippery is a SaaS platform that allows users to create automated email drip series and embed signup forms on external websites. The service is provided "as is" during the beta phase.

Beta program: Drippery is currently in beta. Features may change, be removed, or behave unexpectedly. Beta users accept that the service may be unstable and that data loss, while unlikely, is possible.

2. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to use Drippery.
• One person or legal entity may not maintain more than one free account.
• You are responsible for all activity that occurs under your account.

Drippery reserves the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use Drippery to:

• Send spam, unsolicited emails, or messages to people who have not opted in
• Distribute malware, phishing content, or any harmful material
• Violate any applicable laws or regulations (including CAN-SPAM, GDPR, CASL)
• Impersonate any person or entity
• Attempt to gain unauthorized access to Drippery's systems or other users' accounts
• Use the service to harm, harass, or deceive recipients
• Scrape or extract data from the platform beyond normal use

You are solely responsible for the content of emails you send through Drippery and for ensuring your use complies with all applicable laws in your jurisdiction.

4. Email Sending and Deliverability

• Drippery uses third-party email infrastructure (currently Resend) to deliver emails on your behalf.
• Drippery does not guarantee email delivery. Factors outside our control — including recipient spam filters, ISP policies, and sender reputation — may affect deliverability.
• You must ensure all recipients have explicitly opted in to receive emails from you.
• You must include a valid unsubscribe mechanism in every email. Drippery provides this by default via HMAC-signed unsubscribe links.
• Drippery reserves the right to suspend sending for accounts with high bounce rates, spam complaints, or suspicious activity.

5. Beta Program

• Beta access grants 14 days of Pro plan features at no cost. No credit card is required.
• Beta access is limited to 50 users and is offered at Drippery's sole discretion.
• Beta access may be revoked at any time without notice.
• After the beta period, your account will revert to the Free plan unless you subscribe to a paid plan.
• Feedback provided during beta may be used to improve the service. You grant Drippery a non-exclusive, royalty-free license to use any feedback you provide.

6. Payments and Subscriptions

• Paid plans are billed monthly or annually in advance.
• Starter plan: $9/month (or $7/month billed annually)
• Pro plan: $19/month (or $15/month billed annually)
• Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds: Drippery does not offer refunds for partial billing periods. If you cancel, you retain access until the end of the current billing period.
• Drippery reserves the right to change pricing with 30 days' notice to existing subscribers.

7. Free Plan Limits

The Free plan includes:

• 1 sequence
• Up to 500 subscribers
• 2 embeds
• No AI features
• No custom domain
• Drippery branding on signup forms

Drippery reserves the right to modify Free plan limits at any time.

8. Intellectual Property

• Your content: You retain ownership of all content you create in Drippery — email copy, sequences, subscriber data, and embed configurations. You grant Drippery a limited license to store and process this content solely to provide the service.
• Drippery's IP: The Drippery platform, including its code, design, trademarks, and documentation, is owned by Daniel Rusnok. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
• Subscriber data: Your subscribers belong to you. Drippery will not use your subscriber lists for any purpose other than sending emails on your behalf.

9. Data Processing and GDPR

Drippery processes personal data on your behalf as a data processor. You are the data controllerfor your subscribers' data.

Data we collect about you (account holder):

• Name and email address (via Clerk authentication)
• Billing information (processed and stored by Stripe — Drippery does not store card details)
• Usage data (sequences created, emails sent, subscriber counts)

Data we process on your behalf (your subscribers):

• Email addresses
• Subscription date and status
• Email open and click events (if tracked)

Data retention:

• Your account data is retained as long as your account is active.
• Subscriber data is deleted when you delete a sequence or your account.
• You can export or delete your data at any time from the Settings page.

Your obligations under GDPR:

• You are responsible for obtaining valid consent from your subscribers before adding them to Drippery.
• You must provide your subscribers with a privacy policy that discloses how their data is processed.
• You must honor subscriber requests to unsubscribe or have their data deleted.

Drippery's infrastructure:

• Hosting: Render.com (United States)
• Email delivery: Resend (United States)
• Authentication: Clerk (United States)
• Payments: Stripe (United States)

Data transfers outside the EU are covered by standard contractual clauses or equivalent mechanisms where applicable.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Drippery is provided "as is" without warranties of any kind, express or implied.
• Drippery does not warrant that the service will be uninterrupted, error-free, or free of harmful components.
• Drippery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
• Drippery's total liability to you for any claim arising from use of the service shall not exceed the amount you paid for the service in the 3 months preceding the claim.
• These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise).

11. Termination

• You may delete your account at any time from the Settings page. Deletion is permanent.
• Drippery may suspend or terminate your account immediately if you violate these Terms, engage in abusive behavior, or if required by law.
• Upon termination, your right to use the service ends immediately. Your data will be deleted within 30 days.

12. Changes to These Terms

Drippery may update these Terms at any time. If changes are material, we will notify you by email at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of the Czech Republic, unless mandatory consumer protection laws in your country of residence provide otherwise.
